Chap. 215. - An ACT concerning the Little Kanawha bridge company.

Be it enacted by the general assembly, That the Little Kanawha bridge company be and they are hereby authorized to purchase from the proprietor, and to hold as their property, the ferry from the town of Parkersburg, at or near the foot of Avery street, across the Little Kanawha river, together with the rights, privileges, franchises, roadways, landings and appurtenances, of whatsoever nature, to the same belonging or in anywise appertaining.
Be it further enacted, That so long as the bridge of the said company is in proper condition to accommodate all persons, with their vehicles, stock, et cetera, who may desire to cross the said river to or from the town of Parkersburg, the said company shall not be required to provide and keep at the said ferry, flats, boats or other craft suitable for crossing the same; nor shall the said ferry, and the rights and privileges thereunto belonging or appertaining, be or become forfeited for any omission of the said company to provide and keep thereat flats, boats, and other craft as aforesaid; nor shall the said company be or become liable to any prosecution, penalty or damages, for refusing to set across the said ferry any persons, stock, vehicles or other things, while the said bridge remains in proper condition as aforesaid: Provided however, That the said company shall not charge or receive any higher rates or tolls for passing the said bridge than are now allowed by law to be charged for crossing at the said ferry.
Be it further enacted, That it shall not be lawful for the court of Wood county to establish any ferry across the said river, within one mile of the ferry hereby permitted to be purchased and held by the said company.
